Resignation
Resignation is something which people do it for two reasons. One when you get a better opportunity where growth is perceivable and the other when you or the management cannot see eye in eye! According to Wikipedia , "A resignation is the formal act of giving up or quitting one's office or position."
- Maxim "Resionatio est juris propil spontanea refutatio" It means the act of giving up or relinquishing the office.
- Relinquish an office means to "cease to hold" the office or to "loose hold of" the office.
- The employee should give a notice to the employer or salary in lieu thereof.
- If the employer wants to terminate the employee, it should also serve a notice on the employee.
- The purpose of an employee giving a notice to the employer before his/her resignation is to give the employer time and opportunity to find a substitute.
- The employee can withdraw the resignation before it is accepted by the competent authority.
- Once the resignation is accepted by the competent authority, it can not be withdrawn by the employee.
The resignation shall come into effect only when it is accepted by the competent authority and is communicated the same to the employee in writing. Resignation acceptance is a must. Management might take time to accept the resignation.
