Misuse of PIL

PIL( Public Interest Litigation) is the only weapon   provided by our constitution for  enforcing the Fundamental Right. People are using PIL for fulfilling their personal  gain.PIL has lost its importance. The Courts time is wasted by filing frivolous PIL. Recently the Hon'ble Supreme Court   dismissed the PIL filed by a Gujarat based investor association and Non-government organization to hurdle the forthcoming Reliance Power IPO.  Some one filed the PIL against the disinvestment of BALCO. Now the supreme Court is putting fine on the person who filed the frivolous PIL.  But bona fide litigants of India have nothing to fear. Only those PIL activists who prefer to file frivolous complaints will have to pay compensation to the opposite parties. It is actually a welcome move . The Consumers Protection Act, 1986 has been amended to provide compensation to opposite parties in cases of frivolous complaints made by consumers. There is need to rethink  and reevaluate the concept of PIL. Misuse of it is decreasing its importance. But we can not deny the importance of PIL. The Government should make the necessary amendments in   the constitution to stop the misuse of  PIL.
